RESOLUTION NO. 2. A1- 0 7 A RESOLUTION ACCEPTING BRIARCLIFFE ESTATES PLANNED UNIT DEVELOPMENT, THEREBY REDUCING LETTER OF CREDIT #354 FOR A TWO -YEAR MAINTENANCE PERIOD WHEREAS, pursuant to the Subdivision Regulations, an owner or developer of a subdivision is required to deposit certain security or evidence thereof with the Village of Lemont to guarantee the installation of such improvements; and WHEREAS. in the matter of Briarcliffe Estates Subdivision, located north of 127th Street and east of Smith Road, Irrevocable Letter of Credit #354 was issued by Heritage Bank in the amount of $2,100,000.00 and was deposited with the Village of Lemont on September 3, 2003; and WHEREAS, Briarcliffe Development LLC, in 2004, requested and received several reductions of the Irrevocable Letter of Credit #354 via Resolutions R -2 -04, R -13 -04 and R- 68 -04, to a current balance of $655,429.89; and WHEREAS, on behalf of Briarcliffe Development LLC, DesignTek Engineering has requested the acceptance of Briarcliffe Estates P.U.D. including a final reduction in the Letter of Credit #354 to a balance of $222,730.75, thereby beginning a two -year maintenance period; and WHEREAS, authorized engineer of the Village of Lemont, James Cainkar, has inspected certain portions of the improvement and has recommended acceptance with the following condition: `The detention basins are not to be accepted at this time, as agreed upon by the Village Engineer and McNaughton Development, LLC." NOW, THEREFORE BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont, that Briarcliffe Estates P.U.D. is hereby accepted, with the exception of the detention basins, thereby reducing Irrevocable Letter of Credit #354 to $222,730.75 for a maintenance period of two years. I have reviewed the attached and find it acceptable to lower the amount to $222,730.75 and enter the 2 -year maintenance period; however, I do not recommend acceptance of the detention basins at this time. This reduction request in the amount of $432,699.14 represents new work completed since the third request was made. The remaining LOC amount will be $222,730.75, which represents 10% of the original cost of construction amount, which is required to be held per the annexation agreement. This figure was arrived at by taking the current outstanding LOC amount of $655,429.89 and deducting the required amount to be held of $222,730.75. The total reduction would therefore be $432,699.14. Per the annexation agreement, reduction of the LOC to 10% of the original LOC amount signifies acceptance of all the public improvements and triggers the start of the two (2) year maintenance period. It is therefore our understanding and opinion that once this reduction is approved, the two (2) year maintenance period 'will commence, and two (2) years from the date of this reduction being accepted, the final $222,730.75 will be released.
