WITNESSETH: WHEREAS, Grantor is willing to grant and assign to the Grantee, a temporary easement for ingress and egress subject to the terms, covenants and conditions hereinafter set forth: NOW, THEREFORE, in consideration of the mutual promises and undertakings and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Grantor hereby grants a Temporary Easement for Ingress and Egress to the VILLAGE OF LEMONT, its successors and assigns, for the full and free right of ingress and egress over the Westerly 30 feet of Grantors' property. Grantor shall install a gate at this location with no trespassing signage. 2. Grantor will provide Grantee with a key for said gate and Grantor will be allowed to use the I & M Canal Path for emergency evacuation purposes in the event of an incident in which access across the railroad tracks at Boyer Road is blocked. 3. Grantee will be allowed to access the I & M Canal Path from Boyer Road for maintenance of the Canal and pathways, and will notify Grantor prior to accessing the easement. 4. Grantee will remove the berm from the northern end of the proposed access area. 5. Grantor has the right to terminate this Easement upon 60 days written notice to the Grantee. GRANTORS shall not construct improvements in the Easement Area or change the finish grade of the Easement Area without the consent of the Grantee. THIS EASEMENT is binding upon and shall inure to the benefit of the heirs, successors, assigns, and licensees of the parties hereto.
