A RESOLUTION APPROVING AN EASEMENT ABROGATION PLAT
(1297 Mc CARTHY ROAD)
WHEREAS, the Village of Lemont ( "VILLAGE ") has received an Easement
Abrogation Plat from Robert Wagner ( "Petitioner ") attached as Exhibit "A ", for
property located at 1297 McCarthy Rd. in Lemont, Illinois and which is legally
described as follows:
OF LOT 1,2, AND 3 IN D. KANDICH'S HILLCREST ESTATES, A SUBDIVISION OF ALL
OF THAT PART OF THE EAST 1 / 2 OF THE NORTHEAST 1 / 4 OF SECTION 28, LYING
NORTHERLY OF THE CENTER LINE OF Mc CARTHY ROAD, ALL IN TOWNSHIP 37 NORTH,
RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS; and
WHEREAS, the Petitioner has submitted a Plat to vacate an easement; and
WHEREAS, the Petitioner is the owner of all the lots and consents to the
abrogation of said easement; and
WHEREAS, the appropriate public utilities have certified that they have no
interests in or active utilities in the easement area; and,
WHEREAS, the VILLAGE has no interest in or active utilites in said easement;
and,
WHEREAS, the easement will not affect a public right -of -way; and,
WHEREAS, the vacation of said easement will allow for the re- development of
the properties,
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE, AND WILL, COUNTIES:
SECTION 1: That the Easement Abrogation Plat attached hereto be hereby
approved.
SECTION 2: That the Easement Abrogation Plat attached hereto is to be
duly recorded with the County Recorder of Deeds by Petitioner
at Petitioner's expense.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE AND WILL, ILLINOIS, ON THIS 26th DAY
OF NOVEMBER, 2007.
