R-13-24 Authorizing the Renewal of the Intergovernmental Emergency Warning Sirens Agreement418 Main Street I Lemont, IL 60439 TO: Village Board Meeting FROM: Judy Radomski, Police Department THROUGH: SUBJECT: A Resolution Authorizing the Renewal of the Intergovernmental Emergency Warning Sirens Agreement DATE: February 26, 2024 SUMMARY/BACKGROUND The Village of Lemont and Lemont Township entered into an agreement for the acquisition and maintenance of the Tornado Siren System in 1994. That agreement expired in 2023. Village staff has worked with Lemont Township to update the agreement moving forward. ANALYSIS A new agreement was discussed between the Village and Lemont Township. The parties agree to equally fund future equipment purchases, annual maintenance, and for the annual software needs of the system. The system will be jointly owned by the Village of Lemont and Lemont Township. The agreement will expire on April 30, 2048. Consistency with Village Policy STAFF RECOMMENDATION Staff recommends entering into an Intergovernmental Agreement with Lemont Township. BOARD ACTION REQUESTED Board approval to enter into an Intergovernmental Agreement with Lemont Township. S OLLEN, Village Clerk INTERGOVERNMENTAL EMERGENCY WARNING SIREN AGREEMENT The Village of Lemont (the "Village") hereinafter referred to as "Village"), and Lemont Township (the "Township" hereinafter referred to as "Township," through their respective governing bodies under the intergovernmental cooperation provisions of the Illinois Constitution and Chapter 127, Sec. 741 et seq., commonly known as Intergovernmental Cooperation Act, make the following Emergency Warning Siren Agreement and pursuant to that agreement state as follows: WHEREAS, the parties are desirous of entering into an agreement to jointly fund the purchase and relocation of emergency warning sirens; and WHEREAS, it is agreed that there is a mutual benefit to the parties and that cooperation is in the best interest of the taxpayers served by the parties; and WHEREAS, this mutually funded effort will significantly improve the emergency siren coverage within the Village of Lemont and unincorporated areas of Lemont Township. NOW, THEREFORE, both parties mutually agree as follows: I. SCOPE OF PROJECT. The project scope and equipment specification are outlined in Exhibit A. II. LOCATION OF SIRENS. The installation location of new and relocated sirens shall be in general conformance with the sites identified in Exhibit A. If any change is made to the site location for a new or relocated siren, approval by the Village and Township shall be required. III. FUNDING. The funding of any additions or modifications of emergency sirens will be shared between the Village and Township. This will include all equipment, software, and installation expenses. This also includes the annual maintenance contract, the command and control software, and the system for public notification. The funding percentage will be as follows: Township 50%; Village 50%. IV. MAINTENANCE RESPONSIBILITY. The Village shall be responsible for the routine maintenance related to the sirens. This shall include insurance on all units. The Village and Township shall equally fund the maintenance contract, any major repairs or replacement costs which are not construed to fall within the scope of routine maintenance. V. ELECTRICAL COST. The Village shall be responsible for initiating electrical service accounts to provide electricity to each of the sirens. The Village shall be responsible for adding the sirens to the Village's free electrical service account as allowed under the franchise agreement with Commonwealth Edison. VI. OWNERSHIP OF SIRENS. The emergency sirens shall be jointly owned by the Township and the Village. VII. TERM OF AGREEMENT. This agreement shall become effective and be deemed dated when the last of the parties' duly authorized representatives signs as set forth below, and shall expire April 30, 2048.
