In partnership and consultation with the State of Illinois, over several years we will attempt to address improvements to five public crossings along with potential conversion of private crossings east of our downtown. As an initial phase of the overall program, the Village Board recently approved Phase I engineering for the realignment of Talcott/Pruxne/Main and related rail improvements. That project is in its infant stage. The Village will also be holding a rail meeting in the near future to bring stakeholders together to discuss the two private crossings at McGwure and Boyer, including private stakeholders and Township officials. For the agenda item at the November 13th Village Board Meeting, staff would like to present a Resolution approving an engineering proposal to design and create construction documents to address rail intersection improvements for the Lemont Street, Stephen Street and Holmes Street intersection improvements. These intersections, while difficult due to downtown Lemont's tight configurations, are more straightforward and can be accomplished in a quicker timeframe. While the Village will likely have to pay for this engineering assignment, we have secured 100% funding for all construction improvements through the state once they are engineered. These crossings have not been improved since the late 1990s and improvements will enhance safety significantly especially necessary as the Downtown becomes more active with residents and visitors alike. The agreement is for a not to exceed amount of $204,300. However, it is expected only $90,000 is expected to be expensed in FY 24, which is within the budged figure for the project. While the state typically does not reimburse for engineering, the state has expressed interest in reimbursing for a portion of this engineering work, and the Village will submit post expenditure. If you find this proposal to be acceptable, the Terms and Conditions attached hereto as Attachment A, which set forth the contractual elements of this agreement, will constitute an agreement between Village of Lemont ("Client"), and Veenstra & Kimm, Inc. ("VK") for services on this project. Proiect Understanding VK understands that the Client would like to continue coordination with ICC and CN for planning, design, and construction documents for rail crossing improvements at Lemont Street, Stephen Street, and Holmes Street. Following a rail corridor field review in August 2022, ICC and CN were concerned about rail crossing safety. The Village prepared a proposed comprehensive Rail Crossing Improvement Program in October 2022. ICC replied to the proposed program in November 2022 by including the improvement in the Fiscal Year 2024 to 2028, Crossing Safety Improvement Program (CSIP). The Client met with ICC and CN in June of 2023 to discuss moving forward with improvements at Lemont Street, Stephen Street, and Holmes Street. Improvements will address outdated passive/active controls at the rail crossings, correct deficient unsafe geometric conditions, and address ongoing development and the growing need to accommodate growing bicycle and pedestrian traffic across Main Street and the Heritage Highspeed Rail Corridor. Scope of Services Professional services will include all work associated with data collection, planning, design, and construction documents. Professional services will include all that is necessary to complete the work in conformance with ICC stipulated agreement, petition, or both, as well as CN and ICC design guidelines, policy, and procedures. Proposed improvements at the rail crossings with Lemont Street, Stephen Street, and Holmes Street may be accomplished through ICC stipulated agreement(s). If a new traffic signal installation is warranted at the Main Street intersection with Lemont Street, or other improvements dictate, any one or all of the crossings may require a separate (or combined) ICC petition. No federal funds are identified for the proposed improvements. Scope of services and associated fees for planning, design, and construction documents for rail crossing improvements at Lemont Street, Stephen Street, and Holmes Street are provided below. A) Lemont Street Crossing 1) Existing Conditions — Two quadrant gates with post -mounted signals exist at the rail crossing with 4- way stop control at the adjacent Main Street intersection. See Figure 1. Existing vehicle and pedestrian traffic at this crossing have grown with car shows and other activities. Traffic will increase as Marbella Place (https://marbellaoflemont.comn nears completion, which is under construction just north of the rail crossing on Lemont Street. It will also be important to assess the potential for design of four quadrant gates, which will include the study of pedestrian gates. Given the age of rail traffic control installations — and understanding future needs at this location to address safety concerns — all new railroad control installations are expected. If traffic signals are warranted, and programmed for design and installation, an ICC petition would most likely be required. 3) Workhour Estimate — workhours for data collection, planning, design, construction documents, and coordination are provided as Attachment B. Detail workhour calculation and notes provided in Attachment B can be used to understand the scope of service estimates and any special conditions. Roadway traffic signals do not currently exist at Main Street. If traffic signals are warranted and stakeholders agree on installation, the addition of design detail will be a "planned supplement" to this agreement. Attached B provides notes and a placeholder for this work if warranted and approved. B) Stephen Street Crossing 1) Existing Conditions — Two quadrant gates with cantilevered signals exist at the rail crossing with traffic signals at the adjacent Main Street intersection. See Figure 2. The existing traffic signals at Main Street and the railroad crossing are outdated. Budnick Plaza presents an existing uncontrolled pedestrian rail crossing on the northwest quadrant. Pedestrians line up across the tracks in the red box shown in Figure 3 while waiting to cross Main Street. Geometry at this intersection is a concern. Village police have reported vehicles mistaking the tracks for a road in a left turn movement and driving onto the tracks. -J, . r--r rr kilo ` -., / . It will also be important to assess the potential for design of four quadrant gates, which will likely require shifting the Main Street edge of pavement further south by eliminating or relocating some existing on -street parking spaces on the south side of Main Street. The need for pedestrian gates will also be studied. Similar to Lemont Street crossing, the age of rail traffic control installations — and understanding future needs at this location to address safety concerns — all new railroad control and roadway traffic signal installations are expected. Detail workhour calculation and notes provided in Attachment C can be used to understand the scope of service estimates and any special conditions. C) Holmes Street Crossing 1) Existing Conditions — Two quadrant gates with post -mounted signals exist at the rail crossing with 4- way stop control at the adjacent Main Street intersection. See Figure 4. The roadway profile across the tracks is steep and a challenge to navigate. 2) Proposed Improvements — Several improvement options at this location have been discussed including converting the crossing to pedestrian/bike access only or completely closing the crossing. ICC noted that closing the crossing may create a trespassing issue. Also. limitations exist for crossing closures and further review would be required for vehicular roadway reduction to a pedestrian/bike only crossing. Review and coordination will be undertaken to determine the best improvement option at this location including consideration for adjacent improvements, especially the preferred improvement alternative just east at Main-Illinois-Pruxne/Talcott as well as the new bridge across the I&M Canal just east of Holmes Street. AMENDMENTS This agreement may be amended in writing providing both the Client and Engineer agree to such modifications. COMPENSATION FOR ENGINEERING SERVICES The basis for compensation will be as identified in the agreement. When'Fixed Fee' payment is utilized, it shall include all labor and expenses (for the scope of work as defined in the agreement) incurred by the Engineer and shall not exceed the fixed payment amount without prior authorization of the client. When a'Payroll Cost' (T&M) payment is utilized, it shall be computed by a multiplier factor times payroll cost plus reimbursable expenses. The 'Payroll Cost' means the salaries and wages paid to all Engineering personnel engaged directly on the work plus the cost of customary and statutory benefits including social security contributions, unemployment, health, sick leave, vacation, workman's compensation, incentive, and holiday pay applicable thereto. 'Reimbursable Expenses' means the actual expenses incurred directly or indirectly in connection with the work including but not limited to the following: Transportation and subsistence, toll telephone calls, telegrams, reproduction or printing, computer time, and outside consultants. The 'Multiplier' is a factor for general direct overhead, indirect costs, profit, and other costs. The Multiplier factor rate shall be identified in the agreement. TIME OF PAYMENT The Engineer may submit monthly statements for services and expenses based upon the proportion of the actual work completed at the time of billing. Unless provided for otherwise, payments for engineering services will be due and payable thirty (30) calendar days from the issuance of the Engineer's statement. LATE PAYMENT If the Client fails to make any payment due the Engineer for services and expenses within the time period specified, a service charge of 1'/�% per month will be added to the Clients account. This is an annual rate of 18%. LIMITATION OF LIABILITY The Client agrees to limit the Engineers liability to the Client and to all construction contractors and subcontractors where applicable, on this work, for damages to them, due to the Engineer's negligent acts, errors, or omissions, such that the total aggregate liability of the Engineer to all those named shall not exceed $50,000 or the Engineers total fee for services rendered on this work, whichever is greater. AUTHORITY AND RESPONSIBILITY The Engineer shall not guarantee the work of any Contractor or Subcontractor, shall have no authority to stop work, shall have no supervision or control as to the work or persons doing the work, shall not have charge of the work, shall not be responsible for safety in, on, or about the job site or have any control of the safety or adequacy of any equipment, building component, scaffolding, supports, forms or other work aids, and shall have no duties or responsibilities imposed by the Structural Work Act. TERMINATION This agreement may be terminated by either party upon written notice. Any termination shall only be for good cause such as for legal, unavailability of adequate financing or major changes in the work. In the event of any termination, the Engineer will be paid for all services and expenses rendered to the date of termination on a basis of payroll cost times a multiplier of 2.5 (if not previously provided for) plus reimbursable expenses, plus reasonable termination costs. REUSE OF DOCUMENTS All documents including drawings and specifications furnished by Engineer pursuant to this Agreement are instruments of his services in respect of the work. They are not intended or represented to be suitable for reuse by Client or others on extensions of this work, or on any other work. Any reuse without specific written verification or adaptation by Engineer will be at Client's sole risk, and without liability of Engineer, and Client shall indemnify and hold harmless engineer from all claims, damages, losses, and expenses including attorney's fees arising out of or resulting therefrom. Any such verification or adaptation will entitle engineer to further compensation at rates to be agreed upon by Client and Engineer. ESTIMATE OF COST Since the Engineer has no control over the cost of labor, materials or equipment or over a Contractor(s) method of determining prices, or over competitive bidding or market conditions, his opinions of probable Project Cost or Construction Cost that may be provided for herein over competitive bidding or market conditions, his opinions of probable Project Cost or Construction Cost that may be provided for herein are to be made on the basis of his experience and qualifications and represent his best judgement as a design professional familiar with the construction industry, but Engineer cannot and does not guarantee that proposals, bids or the construction cost will not vary from opinions of probable cost prepared by him. If the Client wishes greater assurance as to the Construction Cost, he shall employ an independent cost estimator.
